General terms and conditions
You are confirming that you are at least 18 years old, and that you agree to be bound by the Terms & Conditions. You may print and keep a copy of the Terms and Conditions, but you acknowledge that Pareto may change any of these terms at any time. When the Terms & Conditions are changed, the changes will appear in this document.
Your use of Pareto’s service after any changes have been posted will constitute your agreement to the modified Terms & Conditions. Therefore, you should read these Terms & Conditions from time to time. If you do not agree to be bound by these Terms & Conditions or any changes thereto, you should not use the Pareto services.
Propriety rights, limitations on use
The Pareto data is protected by copyright and other intellectual property laws, and owned by Pareto or its affiliates, agents or licensors. Pareto data may be used only for your personal, non-commercial purposes. You agree not to modify, copy, reproduce, retransmit, distribute, sell, publish, broadcast, (in whole or in part) create derivative works from or store the Pareto data without the express prior consent of Pareto. The Pareto data must not be used in any manner which competes with Pareto or its affiliates, licensors, agents etc. You cannot use the Pareto data for any unlawful purpose.
All trade names, trademarks, service marks associated with the Pareto data (whether registered or unregistered) (the "Marks") are proprietary to Pareto and/or its licensors and are protected by applicable trademark laws. The word mark “PARETO” and the Pareto figurative mark is a licensed trademark of Pareto AS. Nothing contained in this web site should be construed as granting any license or right to use any of the Marks displayed here without the express written permission of Pareto or its applicable licensors. Any unauthorized use of the Marks is strictly prohibited.
Also, you may not use any of the Pareto data or the Marks in connection with the issuance, trading, as the basis for settlement of a contract on an exchange or other trading platforms, marketing or promotion of investment products (e.g., derivatives, structured products, investment funds, investment portfolios, etc. where the price, return and/or performance of the investment product is based on or related to the Pareto data) without a separate written agreement with Pareto. You acknowledge that Pareto has entered into separate agreements with third parties in order to provide the Pareto data, and that these agreements contains terms and conditions which are implemented in these Terms & Conditions. Further, neither Pareto nor its licensors is giving investment advice, tax advice, legal advice, or other professional advice by providing the Pareto data, and neither Pareto nor its licensors sponsor, recommend or endorse the purchase or sale of any security or investment.
If you violate any of these terms and conditions, Pareto has the right to terminate your access to all or any portion of the Pareto data immediately without notice. Your right to use the Pareto data is subject to any limits established by Pareto in its sole discretion.
Disclaimer of warranties and liability
Pareto data are provided to you “as is”. Neither Pareto nor any of their respective affiliates, agents or licensors warrants the accuracy, completeness, currentness or fitness for a particular purpose of the Pareto data.
Neither Pareto nor any of its affiliates, agents or licensors shall be liable to you or anyone else for any loss, damage or injury resulting directly, indirectly or consequential from use of the Pareto data caused in whole or in part by Pareto’s negligence or contingencies beyond its control in procuring, compiling, interpreting, reporting or delivering the Pareto data as far permitted by law, or arising from (i) any inaccuracy or incompleteness in, or delays, interruptions, errors or omissions in the delivery of the Pareto data or (ii) any decision made or action taken by vendor, any subvensor, subscriber or other third party in reliance upon the Pareto data as permitted by law. Neither Pareto or any of its respective affiliates, agents or licensors be liable to you or anyone else for any damages (including, without limitation, consequential, special, incidental, indirect, or similar damages), for loss of business revenues, lost profits or any punitive, indirect, consequential, special or similar damages whatsoever, whether in contract, tort or otherwise, even if advised of the possibility of such damages as permitted by law. In no event shall the cumulative liability of Pareto or its affiliates, agents or licensors arising out of any legal claim in any way connected to the use of the Pareto services and these Terms & Conditions, exceed the fees paid by the user of the service hereunder during the twelve (12) months prior to the incident giving rise to such claim. The limitations of liability set forth in this section shall not apply damages resulting from either party’s gross negligence, willfulmisconduct or breach of any confidentiality obligations, as permitted by law.
Pareto may discontinue or change the Pareto data or their availability to you, at any time without notice. You accept that Pareto may require you to provide certain information to Pareto or its affiliates, licensors, etc. for auditing and compliance purposes, and to be audited, as required by law.
If any provision in these Terms & Conditions is invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect.
These Terms & Conditions, your rights and obligations, and all actions contemplated by this agreement shall be governed by the laws of Norway, as if these Terms are a contract wholly entered into and wholly performed by the court of Oslo.
These Terms & Conditions constitute the entire agreement between you and Pareto relating to the Pareto data, and they supersede any and all other agreements, oral or in writing, with respect to the data.
The failure of Pareto to insist upon strict compliance with any term or provision shall not be construed as a waiver with regard to any subsequent failure to comply with such term or provision.
